RECRUITMENT SERVICES - Terms & Conditions
These Terms and Conditions of Business deemed to be accepted by way of signature.
DEFINITIONS
- INTRODUCTION means any form of contact brought about by Borch Leeman Recruitment Services (either directly or indirectly or through any third party) between any Candidate and any Client. This applies whether or not the Client knows of such Candidate previously.
Introductions are confidential. Should a Candidate, introduced to a Client, be passed on to a third party, with a resulting engagement, or should a third party engage a Candidate in any capacity as a result of the actions of a Client, then the Client will be liable for payment of the fee as set out in these Terms and Conditions of Business.
- CANDIDATE is any person, firm or company who has any form of contact with a Client of the Agency which is brought about either directly or indirectly by the Agency. This applies whether or not the Client or related entity knows of such candidate previously.
- CLIENT means any person or body to whom a Candidate is introduced by the Agency, either directly or indirectly, whether previously known or not.
- AGENCY means Borch Leeman Recruitment Services.
Our objective is to provide accurate details regarding candidates. However, this is substantially based on information supplied to us. No responsibility can be accepted for errors, omissions or incorrect conclusions. You, the Client, make the final recruitment decision to hire or appoint a candidate. Throughout the recruitment process you must satisfy yourself as to the candidate’s qualifications, competence, integrity and suitability for the position.
Our organisation does not accept liability, either personal or corporate, for compensation for any loss or damage, however arising, which may be suffered or become liable for, as a result of the introduction of a candidate (and your organisation’s decision to employ or make use of the services of that candidate).
The Client undertakes to provide a safe working environment as per the Work cover Act.
The Client agrees to assume all costs associated with Workers Compensation and claims
Should an offer of employment be made to a candidate introduced by us to your organisation then you agree to be bound by these Terms & Conditions of Business and will be liable for the appropriate fees.
ADMINISTRATION COSTS
If after an Offer of Employment has been made to the Applicant and you decide for any reason to withdraw, then you will be liable to pay an Administration Fee.
GUARANTEE PERIOD
Borch Leeman Recruitment Services provides a 12 week guarantee on all placements. A candidate’s departure within 12 weeks of commencement does not fall under this guarantee if it is for reasons not related to competence of the candidate for the position or beyond the control of Borch Leeman Recruitment Services. This includes, but is not exclusive to the candidate leaving for reasons of restructuring of job description, change of terms of employment, redundancy or redeployment caused by the client.
We will replace a candidate, provided that you refill the exact position (Trainee Intern).
GST
All fees are GST exclusive.
PAYMENT TERMS
Our payment terms are 7 days from date of invoice.
This document sets out the basis upon which Borch Leeman Recruitment Services offers to provide recruitment services. The terms and conditions may be varied by agreement in writing and will apply until terminated by either the Company or the Client.
Indemnification
The Client shall continually indemnify and hold harmless Borch Leeman Recruitment Services and its officers, directors, agents, employees and each of them, from and against any and all claims, actions and suits, judgments, losses, damages, costs, charges and other expenses arising from the Client’s engagement of the employees of Borch Leeman Recruitment Services. |
